Well, they were sued for damages, not arrested for illegal activity. The judgment may be knocked down on appeal, but I don't see it being overturned.

As much as this judgment makes us smile, "invasion of privacy and infliction of emotional distress" seems like a pretty shoddy foundation to base it on. Ignoring for a moment what they were protesting, protesting is essentially what they're being punished for. From what I know of the wording of the ruling, I'm not sure there's much to prevent this same argument from being used against real protesters.

I still kind of wonder if the Westboro Baptist Church isn't a giant prank Fred Phelps is pulling just for the lulz. Everything about them is so over-the-top. Nobody's really that obnoxious, are they?

I think it would have been better if they had sued under defamation of character. I would agree with your opinion that their ability to protest and wave banners falls under free speech, and isn't really a good foundation for such a judgment. However, some of the comments made according to the article are most certainly defamation of character, and worse, directed at a defenseless dead guy, and worse, a guy who died serving his country.

yes i think it will stick for the simple fact that you have the freedom of speech to the point of not inflicting harm. the family just has to sue on grounds of emotional damages and freedom of speech is no longer a protection for the church.

at least that is how i understand it.

This was posted a few days ago about Westborow Baptist.

They fUcking own that dumbass. And normally I would think it highly unprofessional of a newscaster to be so abrasive, but this woman deserved it.

I couldn't care less either way about their church. They're simply fanatical Christians taking things to the utmost extremes. I'm actually somewhat impressed at the level of devoutness they possess, however misguided I believe it may be.

no clue, but in that case the protest is a company and not a person, i do not think there would be a case unless it involved liable or slander. again very hard to prove much as with this case.

That's why I don't hate them, though. Something about having that kind of blind faith in anything leaves me in awe, regardless of how idiotic it might be.

Also, you'll find when dealing with people who's shoe size reflects their IQ score, that justification is generally not required for any of their actions. It's like trying to justify why the dumb kid drools on your homework for any reason other than him being retarded.
